TERMS AND CONDITIONS

Administered by: Fiore Verde Cannabis (“Fiore Verde”, “the Company”, “we”, “us”, or “our”)

1. Acceptance of Terms

1.1 These Terms and Conditions (the “Terms”) govern participation in the Fiore Verde Cannabis La Vita Verde Membership Program (the “Program”).

1.2 By purchasing or participating in the Program, you (“Member”, “you”, or “your”) agree to be bound by these Terms.

1.3 If you do not agree to these Terms, you must not participate in the Program.

2. Eligibility

2.1 The Program is open only to legal residents of the Province of Ontario, Canada.

2.2 Members must be at least nineteen (19) years of age as of the date of registration.

2.3 Proof of age and identification may be required at any time to verify eligibility.

2.4 Memberships are personal, non-transferable, and may be used only by the registered Member.

2.5 The Program is void where prohibited by law.

3. Program Overview

3.1 The Program provides Members with access to certain benefits, rewards, and promotional offers (“Benefits”), as described herein.

3.1.1 All members of the program are entitled to a 10% discount on regular priced items in-store and online, subject to applicable laws and exclusions and product availability.

3.1.2 La Dolce Vita Members enjoy enhanced Benefits, including double points on Sundays and Mondays, access to exclusive spotlights, contests, and promotional offers available in-store or online as specified by Fiore Verde Cannabis.

3.2 All Benefits are subject to availability, applicable laws, and these Terms.

3.3 Fiore Verde Cannabis reserves the right to withdraw, amend, suspend, or terminate the Program, in whole or in part, at any time without notice or liability.

4. Compliance with Cannabis Laws

4.1 All Program operations comply with the Cannabis Act (Canada), the Cannabis Licence Act, 2018 (Ontario), and the Registrar’s Standards for Cannabis Retail Stores.

4.2 Program Benefits, rewards, or discounts shall not be offered as inducements to purchase or consume cannabis or cannabis accessories beyond personal use, nor will they promote any specific licensed producer, brand, or supplier.

4.3 Fiore Verde Cannabis promotes the responsible use of cannabis and does not condone overconsumption.

4.4 The 10% Member Discount is offered in compliance with applicable cannabis retail laws and is not intended to induce excessive consumption or promote specific brands. All discounted items are subject to availability and offered while supplies last.

5. Membership Tiers, Fees, Term, and Cancellation

5.1 The La Vita Verde Membership is free to join and provides Members with access to select Program Benefits, subject to availability and applicable laws.

5.1.1 The 10% discount on regular priced items is available to both La Vita Verde and La Dolce Vita Members and applies automatically at checkout in-store and online, while supplies last.

5.2 Members may choose to upgrade to the La Dolce Vita Membership for an annual fee of $35 CAD, which unlocks enhanced Benefits and exclusive offers.

5.3 Membership fees for La Dolce Vita are non-refundable, except as required by law.

5.4 Members may cancel their La Dolce Vita Membership at any time by contacting Fiore Verde Cannabis. No refunds or credits will be issued for unused membership periods. Upon cancellation, Members will retain access to La Vita Verde Benefits but lose access to La Dolce Vita enhancements.

5.5 Fiore Verde Cannabis reserves the right to suspend or terminate any membership, without notice, in cases of suspected fraud, misuse, or breach of these Terms.

6. Membership Benefits

6.1 The following Benefits may be available to Members in Ontario, subject to these Terms and applicable laws.

6.2 Some Benefits require consent to receive marketing communications under Canada’s Anti-Spam Legislation (CASL).

(a) Welcome Voucher

A 500-point voucher, equivalent to a 5% discount on any in-store item, with exclusions, may be provided upon membership purchase.

This voucher expires one (1) year from the date of membership purchase and becomes void upon cancellation of the membership.

(b) Points Per Visit

Members earn 100 points per visit to Fiore Verde Cannabis retail locations in Ontario.

(b.1) Double Points Days (La Dolce Vita Members Only)

La Dolce Vita Members earn double points on purchases made in-store on Sundays and Mondays.

Points are calculated based on eligible purchases only and may not be combined with other promotional multipliers unless expressly stated by Fiore Verde Cannabis.

(c) Birthday Offer

Members may redeem one (1) birthday offer per calendar year for 15% off eligible in-store purchases.

This offer is valid from seven (7) days before to seven (7) days after the Member’s birthday, while supplies last.

Offers are available in-store only and cannot be combined with other promotions. They may be modified or discontinued at any time.

(d) Exclusive Accessories and Apparel

Members may access La Vita Verde-exclusive cannabis accessories and apparel, available while supplies last.

The Company makes reasonable efforts to provide such exclusive items, but does not guarantee availability or continuity.

(e) Weekly Spotlights

All Members may receive access to limited-time Weekly Spotlights on designated products.
Enhanced Weekly Spotlights, featuring additional savings or early access to select offers, are available exclusively to La Dolce Vita Members.

Spotlights are available while supplies last and may be ended or modified without notice.

(f) Exclusive Contests and Enhanced Promotions (La Dolce Vita Members Only)

La Dolce Vita Members gain access to exclusive contests, enhanced promotional events, and featured partner offers throughout the year. These Benefits may vary in frequency and availability and are communicated primarily through the La Dolce Vita Member Newsletter.

(g) Member Discount

All members receive 10% off regular priced items in-store and online.

This discount is automatically applied at checkout and cannot be combined with other promotions or offers unless explicitly stated.

Discounted items are available while supplies last, and Fiore Verde Cannabis does not guarantee stock availability for any specific product. 

7. Privacy and Personal Information

7.1 Fiore Verde Cannabis collects, uses, and discloses personal information in accordance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

7.2 Personal information is collected for the purpose of administering and improving the Program, verifying eligibility, and communicating with Members.

7.3 Personal information will not be disclosed to third parties except as required by law or to fulfill Program administration purposes.

7.5 By participating in the Program, Members consent to the collection, use, and disclosure of their personal information as described in these Terms.

8. Electronic Communications (CASL Compliance)

8.1 By joining the Program and opting in to receive communications, Members consent to receiving electronic messages from Fiore Verde Cannabis regarding Program benefits, promotions, and updates, in compliance with Canada’s Anti-Spam Legislation (CASL).

8.2 Members may withdraw consent at any time by using the unsubscribe link included in Fiore Verde Cannabis emails or by contacting the Company directly.

8.3 All Members may opt in to receive the Fiore Verde Cannabis newsletter.

La Dolce Vita Members will receive an enhanced version of the newsletter containing exclusive updates, contests, and promotional content.

La Vita Verde Members may receive general Program updates and offers but not La Dolce Vita–exclusive content.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, Fiore Verde Cannabis and its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in the Program.

9.2 Fiore Verde Cannabis is not responsible for:

a. Technical errors, system failures, or data issues;

b. Lost, late, incomplete, or corrupted entries or communications; or

c. Unauthorized access to, or alteration of, Member data.

9.3 The total liability of Fiore Verde Cannabis to any Member shall not exceed the total amount paid by the Member for the applicable membership term.

10. Program Integrity and Security

10.1 Any attempt to deliberately damage any Fiore Verde Cannabis website or to undermine the legitimate operation of the Program may constitute a violation of criminal or civil laws.

10.2 Fiore Verde Cannabis reserves the right to seek damages and/or criminal prosecution to the fullest extent permitted by law.

11. Governing Law and Jurisdiction

11.1 These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

11.2 Any disputes arising in connection with the Program shall be subject to the exclusive jurisdiction of the courts of Ontario.

12. Amendments

12.1 Fiore Verde Cannabis may amend these Terms at any time without prior notice.

12.2 The Company will make reasonable efforts to notify Members of any material changes to the Program or these Terms.

13. Severability

13.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

14.1 These Terms constitute the entire agreement between Fiore Verde Cannabis and the Member regarding the Program and supersede all prior representations, understandings, or agreements, whether written or oral.
